Most federal work injuries in the DMV are traumatic: a fall, a lift, a vehicle. Montgomery County's federal workforce is the exception. NIH and FDA scientists, NIST engineers, NRC reviewers and HHS program staff develop conditions over years — carpal tunnel and cubital tunnel from pipetting and keying, cervical and lumbar disc conditions from microscope and workstation posture, shoulder impingement from bench work, and exposure-related illness in laboratory and animal-care settings. I've developed carpal tunnel from years of lab work at NIH. Is that a federal work comp claim?
It can be. Conditions caused by repetitive work activity over time — carpal tunnel, cubital tunnel, tendinopathy, posture-related spine conditions — are occupational diseases under FECA, filed on Form CA-2 rather than CA-1. These claims depend on a physician's rationalized opinion tying your specific duties (pipetting, microscopy, keying, hours per day, years in the role) to the diagnosis. Our Rockville DOL doctors take that history and write the CA-20 and narrative report accordingly. Continuation of Pay does not apply to CA-2 claims; wage loss is claimed on Form CA-7.
Are NIH and FDA contractors and fellows covered by FECA?
Generally no. FECA covers federal civilian employees — civil-service, Commissioned Corps and Title 42 employees of NIH, FDA and other agencies — and all USPS employees. Contractor employees are covered by their employer's Maryland workers' compensation, and most postdoctoral fellows and trainees on stipends are not FECA-covered. Is federal workers' comp the same as Maryland workers' comp?
No. Federal and postal employees' claims run through the U.S. Department of Labor's OWCP under FECA — not the Maryland Workers' Compensation Commission. FECA has its own forms (CA-1, CA-2, CA-7, CA-16, CA-17, CA-20), your own choice of physician, Continuation of Pay for the first 45 days after a traumatic injury, and a schedule award system for permanent impairment. Federal Injury Centers treats federal claims exclusively.
What does a visit cost?
Nothing out of pocket on an accepted OWCP claim — no copays or deductibles. We bill OWCP directly and do not bill your personal health insurance or FEHB plan for a work injury. Mileage and Metro fares to the clinic are reimbursable on Form OWCP-957.
